1. Driver’s
licence and age limit
A valid national driver’s licence is required and to be produced upon
vehicle collection. The INTERNATIONAL DRIVERS LICENCE IS NOT REQUIRED.
Minimum age: 21
years
2. Damage Cover (types of cover)
2.1 Basic Cover Standard Excess Insurance Cover, included in rental price.
Damage
Liability AUD 7,500, applies in
respect of each claim.
All Easy Life vehicles come with standard insurance cover. A bond of AUD 7,500
is taken to cover the excess in the event of any damage to our vehicle or third party property damage, and has to be paid into our bank
account no later than 14 days prior to the start of rental. The AUD
7,500 are per incident and therefore an open signed credit card imprint will be
taken at handover of the vehicle. It will also incur an additional surcharge of
5.0 %, AUD 375, a non refundable administration fee.
The hirer
will also be fully liable for demurrage - the daily rental rate for the period
the vehicle is off fleet for accident repairs (max 14 days) - and for replacing
or repairing damaged windscreens and tyres. Overhead (everything above 2.1m)
and under-body damage, damage to air/conditioning, solar panel, antenna, awning
or any other addition to the rented vehicle is not covered.
The bond is
fully refundable by bank transfer on return of the vehicle to the agreed
location, on the agreed date in clean condition with no damage incurred to the
Easy Life vehicles, with a fuel tank as agreed, the toilet cassette and waste
water tank emptied and no equipment lost or damaged and no third party claims
expected to be lodged.
Fluctuating exchange rates, the difference between buy and sell rates charged
by banks as well as bank fees, may result in the amount refunded being
different. Easy Life Tours & Rentals Australia Pty Ltd is not liable for
currency variations or bank transaction fees which may be payable, depending on
the provider/bank.
2.2 Option 1, Excess
Reduction 1 (ER1),
Compulsory for drivers between 21-24 and 70
years and over.
AUD 20 per day, to a maximum of 50 days or AUD 1,000
Will reduce
the excess for any damage to the vehicle or third party property damage to a maximum of AUD 1,500 for hirer
between 25 and 69 and AUD 2,000 for hirer between 21 and 24 and over 70.
Damage
Liability applies in respect of each claim.
The hirer, however, will be fully liable for demurrage - the daily rental rate
for the period the vehicle is off fleet for accident repairs (max 14 days) -
and for replacing or repairing damaged windscreens and tyres. Overhead
(everything above 2.1m) and under-body damage, damage to air/conditioning,

covered. A bond of AUD 1,500/2,000 is payable at the time of pick up by an open
signed credit card imprint. The bond is fully refundable on return of the
vehicle to the agreed location, on the agreed date, in clean condition with no
damage incurred, with a fuel tank as agreed, the toilet cassette and waste
water tank emptied and no equipment lost or damaged.
2.3 Option 2, Excess
Reduction 2 (ER2)
Only
drivers aged between 25 and 69 years can purchase ER2.
AUD 33 per day, to a maximum of 50 days or AUD 1,650
Will waive
the excess for vehicle damage and third party property damage and the cost of replacing or repairing
windscreens and tyres.
Overhead
(everything above 2.1m) and under-body damage, damage to air/conditioning,
solar panel, antenna, awning or any other addition to the rented vehicle is not
covered.
A bond of
AUD 300 is payable by an open signed credit card imprint at the time of vehicle
pick up. The bond is fully refundable on return of the vehicle to the agreed
location, on the agreed date, in clean condition with no damage incurred, with
a fuel tank as agreed, the toilet cassette and waste water tank emptied and no
equipment lost or damaged.
2.4 Option3, Excess Reduction 3, All Inclusive Rate (AIR3)
Only
drivers aged between 25 and 69 years can purchase AIR3.
AUD 45 per day, to a maximum of 50 days or AUD 2,250 for vehicle type B2B.
AUD 55
per day, to a maximum of 50 days or AUD 2,750 for all other vehicle types.
The All
Inclusive Rate includes:
A bond of
AUD 300 is payable by an open signed credit card imprint at the time of vehicle
pick up. The bond is fully refundable on return of the vehicle to the agreed location,
on the agreed date with a fuel tank as agreed, the toilet cassette and waste
water tank emptied and no equipment lost or damaged.
2.5 Conditions
The cover stated in points 2.1,
2.2, 2.3 and 2.4 is subject to:
a) Your not having acted or having caused any other person to have acted in
any manner which is in contravention of this agreement.
b) Your not being covered under any policy of insurance.
c) The
full payment of any additional charges or fees.
d) Your providing such information and assistance as may be requested and,
if necessary, authorising the company insurer to bring, defend or settle legal
proceedings, but Easy Life shall have sole conduct of the proceedings.
3. Unauthorised
and Prohibited use
Persons who must not
drive the vehicle:
a) A person not nominated as driver in the acceptance report or not
approved by Easy Life.
b) A person who is not licensed for that class of vehicle.
c) A person whose blood alcohol concentration exceeds the lawful
percentage.
d) A person who has given or for whom you have given a false name, age,
address or driver’s licence details.
Circumstances
in which and/or for which the vehicle must not be used:
e) If the vehicle shows obvious malfunctions.
f) Driving on the beach and/or in salt-water (e.g. Fraser Island or
driving to/on salt lakes). In the case of non-compliance with this
regulation, a charge of AUD 1,500 applies for thorough cleaning and
rust-proofing measures (diminishing value of the vehicle).
g) To carry persons for hire or to carry any inflammable, explosive or
corrosive material, except where provided by Easy Life.
h) To propel or tow any vehicle, trailer, boat or other objects unless Easy
Life has authorised such use in writing.
i) To carry any greater load and/or more persons than is lawful or use in a
manner or for a purpose other than for which it was designed and constructed.
j) For racing, pacemaking, reliability trials, speed trials, hill climbing
or being tested in preparation for those purposes.
k) In a dangerous manner.
l) In contravention of any legislation or regulation controlling vehicular
traffic or for any illegal purposes.
4. Financial
obligations
Special
Note: Joint hirers and all drivers are jointly and severally responsible under
this agreement.
You
are responsible for and by entering into the contract you authorise Easy Life
to debit your credit card with the following charges:
a) All rental charges specified in the acceptance report.
b) All charges claimed from Easy Life in respect of parking or any traffic
violations incurred during the period of hire or until such later time as the
vehicle is returned to the company. A handling fee of AUD 88 (AUD 44 if it can be done
online) will be charged to your credit card.
c) All loss or damage to the vehicle (including loss of use/off fleet),
Third Party Damages, legal expenses, assessment fees, towing and recovery,
storage and company service charges where:
c1) Any condition of this agreement
has been breached.
c2) The under body of the vehicle is
damaged regardless of cause when no other vehicle is involved, unless you purchased AIR3.
c3) The tyres of the vehicle are
damaged other than by normal wear, unless you purchased ER2 or AIR3.
c4) The vehicle is totally or
partially immersed in water regardless of cause.
c5) You have failed to maintain all
fluid levels or failed to immediately rectify or report Easy Life any defect of which you become aware.
c6) The upper body of the vehicle is
damaged by driving it under or into an object lower than the height of the vehicle, unless you
purchased AIR3.
c7) You have left the vehicle
unlocked or left the keys in the vehicle.
c8) You have not kept the key secure
and under your personal control.
5. Acceptance, rental period, return and cleaning of vehicle
The
rental period is calculated according to the number of days the vehicle is
rented. Pick up or drop off days are always counted as a full day, irrespective
of what time it is collected or dropped off.
If
the vehicle is not handed back on the agreed date, or if the vehicle is not
returned to the agreed place, Easy Life reserves the right to charge the renter
any costs resulting from this. If the vehicle is returned before the date
specified on the acceptance report, the hirer is not entitled to a refund.
The cleaning deposit will only be fully refunded if the vehicle is returned
with a clean inside, clean equipment, a clean, emptied toilet and empty holding
tank. On handover and return the gas cylinders or methylated spirit bottle have
to be full, fuel tanks have to be at the same level as on handover.
6. General
provisions
b) In case of mechanical problems with the vehicle or any malfunction of
equipment (e.g. refrigerator, air conditioner etc.) which could reasonably be
expected to affect continuation of the trip, Easy Life is to be advised
immediately. Repairs must only be commissioned after prior approval by Easy
Life.
c) The vehicle and receipts for service work are checked by Easy Life upon
return of the vehicle. Expenses for vehicle service and maintenance (excluding petrol and oil used for top-ups) are reimbursed if the above conditions were adhered to.
Any damage, loss and neglected maintenance will be charged to the hirer.
d) If, as a result of mechanical breakdown, the rental vehicle can’t be used
for a period longer than 24 hours and Easy Life can’t provide a replacement
vehicle, the hirer is entitled to a refund of the paid daily rental fee
(excluding fees paid for reduced insurance excess and any other additional
charges) for each day the vehicle cannot be used. If the hirer is able to sleep
in the vehicle, a reduced daily rental fee will be paid. This indemnity can
only be claimed, if the damage has not been caused by the hirer.
e) Easy Life can provide you with child restraints and booster seats.
However, Easy Life cannot be held responsible for the correct use and
installation of the child restraints and the anchorage points in the vehicle.
f) If,
for reasons beyond our control, the reserved vehicle is not available, Easy
Life reserve the right to substitute a comparable or superior vehicle at no
extra cost to the hirer. This shall not constitute a breach of contract and
does not entitle the hirer to any form of refund.
7. The
hirer agrees:
a) To regularly check tyre pressure and battery electrolyte level
(including auxiliary battery, if applicable).
b) To check engine oil level and radiator coolant level every morning.
c) To notify Easy Life immediately of any water leaks (roof or elsewhere),
damage to the vehicle and undefined noises. The hirer agrees to get it repaired
immediately, if Easy Life decides to have it repaired during the hirers rental
period.
d) To pay any damage to interior or exterior as a result of fixing or
adding things other then authorised by Easy Life, regardless of damage cover.
e) To pay any damage to interior or exterior as a result of children
handling things inappropriately, regardless of damage cover.
f) fter every 15,000 km driven or at the odometer reading stated on the
service sticker, to have the vehicle serviced by a service station of OUR
choice (prior approval required).
8. Reservation
/ Conditions of payment
20%
of the rental price is payable at the time of confirming the reservation or
signing the contract.
No
reservation of vehicles is possible, without the 20% deposit.
The
remainder is payable either at the time of collecting the vehicle or no later
than 14 days prior to the start of rental, into our bank account. We accept
MasterCard and VISA cards without any surcharge.
At
the time of vehicle collection a security deposit amounting to the
damage-liability (with ER2 and AIR3 option, the security deposit amounts
to AUD 300), must be lodged (deposit by credit card is possible). However, if
BC cover is chosen, the AUD 7,500 plus admin fee of AUD 375 is to be paid into
our bank account no later than 14 days prior to the start of rental.
A
cleaning deposit of AUD 150 is required on handover (refund according to point
5).
9. Cancellation
Apart
from a cancellation handling fee of AUD 150, the following cancellation costs,
in per cent of the total amount, are charged:
60 - 31 days prior to commencement of the trip 50%
30 - 0 days prior to commencement of
the trip 100%
If the vehicle is
returned before the date specified in the contract, the hirer is not entitled
to a refund.
Any
claims or legal action in connection with the provision of our services to the
hirer will be governed by the laws of Australia.
